Terms of Service
What you can expect from HypoText, and what we expect from you.
Draft — pending legal review
This document describes how the product actually works today, written as a starting point. It has not been reviewed by counsel and is not yet a binding agreement.
Last updated 8 October 2026
1. What HypoText provides
HypoText operates an edge layer that sits in front of your brand’s web presence. Depending on the products you enable, the service may:
- detect whether an incoming request comes from an AI crawler or a human, and serve each a different representation of the same content (Infra);
- query public AI assistants with questions relevant to your category and record whether, and how, your brand is referenced (Discovery);
- vary the emphasis of a page based on which AI platform referred the visitor (Persona).
In all cases the underlying facts served to bots and to humans are the same. We do not create content that contradicts what your brand publishes, and we do not conceal content from one audience that is shown to the other.
2. Your account and your content
You keep ownership of everything you publish. By connecting a domain you grant us the limited right to fetch, transform, cache and serve that content for the purpose of operating the service.
You are responsible for having the right to publish the content you route through HypoText, and for ensuring it is accurate. You must keep account credentials secure and tell us promptly if you believe they have been compromised.
3. Acceptable use
You agree not to use HypoText to:
- serve AI crawlers claims that differ materially from what human visitors are shown;
- misrepresent another brand, person or organisation;
- publish unlawful content, or content you have no right to use;
- attempt to overwhelm, reverse engineer or circumvent the service or its rate limits.
Serving deliberately divergent content to crawlers is cloaking. It breaches search and AI platform policies, it is not what this product is for, and we will suspend accounts that attempt it.
4. Third-party AI platforms
Discovery reports on output produced by systems we do not control. Those systems change their models, their retrieval behaviour and their policies without notice. We therefore do not guarantee any particular citation, ranking, mention or sentiment, and nothing in the service should be read as a promise of a commercial outcome.
5. Fees
Fees are usage-based and set out in your order. Usage is measured on bot requests served, pages in scope, crawl frequency and the complexity of any custom edge logic. Unless your order says otherwise, fees are billed monthly in advance and usage overages in arrears.
6. Availability and support
We aim for continuous availability and will give notice of planned maintenance where we reasonably can. Service levels, where they apply, are those stated in your order. Enterprise plans include a defined SLA; other plans are provided on a commercially reasonable efforts basis.
7. Suspension and termination
You may stop using the service at any time. We may suspend an account for non-payment, for a breach of section 3, or where continued operation would expose us or other customers to legal or security risk. On termination we will stop serving your content and delete or return your data in line with section 8 of our Privacy Policy.
8. Liability
Nothing here limits liability that cannot lawfully be limited. Subject to that, neither party is liable for indirect or consequential loss, and our total liability in any twelve-month period is capped at the fees you paid in that period.
9. Changes to these terms
We may update these terms as the product changes. For material changes we will give reasonable notice before they take effect. Continuing to use the service after that point means you accept the updated terms.
